A killing that was planned and deliberate will be first degree murder. A murder other than first degree murder, will be second degree murder.

The minimum punishment for first degree murder is life in prison with eligibility for parole no earlier than 25 years. The minimum punishment for second degree murder is life in prison with eligibility for parole no earlier than 10 years. There is no minimum prison sentence for manslaughter unless there is an aggravating factor such as if the offense was committed with a firearm.
